The judge rejected special police officer (SPO) Hemo Hamid Wani\u2019s argument that he was entitled to the \u201csame powers, privileges and protections available to ordinary officers of police under Police Act\u201d. The HC pointed out that \u201cSPOs do not hold any civil posts regulated by statutory rules\u201d.<span class=\"id-r-component br\" data-pos=\"6\"\/>Residents of a neighbourhood are appointed SPOs \u201cfor specific purposes when the force ordinarily employed for preserving peace is not sufficient\u201d. \u201cThus, engagement of SPOs is not of a permanent nature but only to take care of a particular contingency,\u201d the HC noted.<span class=\"id-r-component br\" data-pos=\"8\"\/>Wani was engaged as an SPO in 2012. In 2015, he was posted at Reshipora in south Kashmir\u2019s Shopian. While at home on medical leave at one point then, he received life threats from terrorists and failed to report back to duties. When he returned after some time to his posting, he was not allowed to join duty, forcing him to take the matter to senior officers.<span class=\"id-r-component br\" data-pos=\"12\"\/>When no action was taken, Wani moved the HC. In Aug last year, the court directed the J&amp;K police DGP to take a decision on Wani\u2019s plea. Even if it is assumed that Wani had the right to such a hearing, his failure to perform duties in the face of terror threats is enough reason to remove him, the HC held.<span class=\"id-r-component br\" data-pos=\"22\"\/>\u201cGranting an opportunity to the petitioner to present his case prior to disengagement would have been an empty formality. The DGP has rightly rejected the petitioner\u2019s representation.
